ModemGuides.com ("ModemGuides," "we," "us," or "our") is operated by Archer Networks LLC, a Montana limited liability company. This Privacy Policy explains what information we collect when you visit our site, chat with us, place an order, or sell us a device, how we use and share that information, and the choices and rights you have.
Information We Collect
Information you provide
- Orders and checkout: your name, billing and shipping addresses, email address, phone number, and payment details when you place an order.
- Buyback program: if you sell us a device, we collect your name, email address, phone number, shipping address, details about the device (such as brand, model, and condition), and the payout information needed to pay you.
- Accounts: if you create a customer account, we store your name, addresses, email, and phone number to pre-fill future checkouts.
- Chat, contact form, and support: messages you send through our chat widget, contact form, or email, along with any information you include in them.
- Reviews and blog comments: content you choose to post on our site, along with the name and email address you submit with it.
Information collected automatically
- Device and browsing data: IP address, browser type, general location, pages and products viewed, and how you arrived at our site. We use this for things like estimating taxes and shipping, showing recently viewed products, and improving the store.
- Cookies and similar technologies: described in the Cookies section below.
How We Use Information
- Process and ship orders, send confirmations and shipping updates, and provide receipts
- Run our device buyback program: review your submission, generate a prepaid shipping label, communicate with you about your trade-in, and send your payment
- Respond to your requests, including warranty claims, returns, refunds, and complaints
- Process payments and screen orders for fraud
- Set up and maintain your customer account
- Comply with legal obligations, such as calculating taxes and keeping tax and accounting records
- Improve our store, product pages, and guides, including testing designs and measuring errors
- Send marketing messages if you have opted in (you can unsubscribe at any time)
Device Buyback Program
When you sell us a device through our buyback program, we use the information you provide for that transaction: to review and confirm your offer, generate a prepaid shipping label in your name, communicate with you about the status of your trade-in, and send your payment. Your name and address are shared with the shipping carrier to create the label, and your payout details are shared with the payment provider used to send your payment. Buyback records are kept with our other transaction records for tax and accounting purposes. We do not use buyback contact details for marketing unless you separately opt in.
AI-Assisted Chat
We use Shopify to power AI-assisted chat on our online store. When you open the chat widget, your questions may be answered by an AI assistant rather than a member of our team, and the chat displays a notice when you are chatting with AI.
Shopify processes customer data, including chat communications, to generate responses and to improve the quality of the AI chat feature over time. The assistant answers using our product catalog, store policies, and site pages. Conversations are saved to our inbox, and our team can review them for accuracy and follow-up.
You can ask to speak with a person at any time. If a conversation is handed off to our staff, the earlier chat history carries over so you do not have to repeat yourself. If our staff are unavailable, the assistant will share our support email address so you can reach us directly. Order lookups through chat are only available after you sign in to your customer account.
Please do not share sensitive information, such as full payment card numbers or government ID numbers, in chat. For more on how Shopify handles data, see the Shopify Privacy Policy.
Blog Comments and Reviews
Our blog allows comments, and our product pages may display reviews. When you submit a comment, we collect the name and email address you enter. The name appears publicly with your comment; the email address is not published. Comments may be held for moderation before they appear. If you would like a comment or review you posted removed, email support@modemguides.com and we will take it down.
Cookies and Tracking Technologies
We and our service providers use cookies, web beacons (small tracking pixels), and similar technologies. A cookie is a small text file placed on your device. We use these tools to:
- Keep items in your cart while you browse and keep you signed in to your account
- Remember your preferences so you do not have to re-enter the same information
- Recognize new and returning visitors and understand how the site is used
- Measure errors, test designs, and improve site performance
- Understand which pages, searches, and ads bring visitors to the store and measure email campaigns
Most browsers accept cookies by default, and your browser settings let you refuse or delete them. If you block cookies, some features (such as signing in or keeping items in your cart) may not work, and not all tracking described here will stop. Cookie choices are specific to each browser and device.
Interest-Based Advertising
We and our advertising partners may show you interest-based ads: ads selected for you based on your activity over time across websites and apps, such as products you viewed or purchased. These ads may appear on our site, on other websites and apps, or in email, and may be shown by us or by third parties. Our partners may combine information collected on our site with information from other sources, such as other online activity.
Google AdSense
We use Google AdSense to display ads on parts of our site. Third-party vendors, including Google, use cookies to serve ads based on your prior visits to our site or to other websites. Google's use of advertising cookies enables it and its partners to serve ads to you based on your visits to this site and other sites on the internet. You can opt out of personalized advertising from Google in Google Ads Settings, and you can learn more about how Google uses data from sites that use its services at policies.google.com/technologies/partner-sites.
Your advertising choices
- Opt out of interest-based ads from participating companies through the Digital Advertising Alliance at optout.aboutads.info or the Network Advertising Initiative at optout.networkadvertising.org.
- Opt out of Google's personalized ads at adssettings.google.com, and adjust similar settings in your Meta and other platform accounts.
- Use a browser-based opt-out preference signal such as Global Privacy Control (GPC). Where applicable law requires us to honor these signals, we do.
Some browsers also offer a separate "Do Not Track" setting. There is no common standard for interpreting Do Not Track signals, so like most sites we do not respond to them. The opt-out tools above are the more reliable option.
Affiliate Links
Some product links on our site are affiliate links to Amazon. As an Amazon Associate, we earn from qualifying purchases made through those links, at no extra cost to you. When you click an affiliate link, Amazon places cookies in your browser to attribute your visit to our site. We receive aggregated reports about purchases made through our links, but Amazon does not share your identity or personal information with us. Once you leave our site, Amazon's own Privacy Notice applies.
How We Share Information
- Shopify: our store is hosted on Shopify, which provides our e-commerce platform, checkout, data storage, and chat, and powers our AI-assisted chat as described above.
- Payment processors: Shopify Payments and PayPal. Your payment details pass directly to the processor to complete or support the payment; see the PayPal Privacy Statement for details. We never store your full card number on our systems. If we send you a payment through the buyback program, the payout details you provide go to the payment provider used to send it.
- Shipping and fulfillment: carriers receive your name, address, email, and phone number as needed to deliver your order or to provide a prepaid shipping label for a buyback trade-in.
- Advertising and affiliate partners: Google, for the AdSense ads described above, and Amazon, for affiliate link attribution.
- Service providers: analytics, email delivery, and fraud prevention partners that support the activities described in this policy.
- Legal and safety: when required by law, to respond to lawful requests, to enforce our terms, or to protect the rights, property, or safety of ModemGuides, our customers, or others.
- Business transfers: if we are ever involved in a merger, acquisition, or sale of assets, customer information may transfer as part of that transaction.
We do not sell your personal information for money. Like most online stores, our use of advertising and analytics cookies may count as "sharing" or "targeted advertising" under some state privacy laws; the choices above and the rights below let you opt out.
Data Retention
- Order records (name, email, billing and shipping addresses, items purchased) are kept for up to 10 years for tax, accounting, and warranty purposes.
- Buyback transaction records (your contact details, device information, and payout records) are kept with order records for the same tax and accounting purposes.
- Customer account information is kept until you ask us to delete your account.
- Chat transcripts and support emails are kept as long as needed to resolve your request and maintain a support history.
- Reviews and blog comments remain posted until you ask us to remove them.
Security
Our site is served over HTTPS, checkout runs on Shopify's PCI DSS compliant infrastructure, and payment card details go directly to our payment processors, so we never see or store full card numbers. Access to customer information is limited to the team members who need it to fulfill orders, process refunds, and provide support. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a data incident affects your information, we will investigate promptly and notify you as required by law, along with steps you can take to protect yourself.
Your Privacy Rights
United States
Depending on where you live, state privacy laws (including those in California, Colorado, Connecticut, Montana, Oregon, Texas, Virginia, and a growing number of other states) may give you the right to:
- Know what personal information we have collected about you and receive a copy of it
- Correct inaccurate personal information
- Delete personal information we hold about you
- Opt out of targeted advertising and of the "sale" or "sharing" of personal information as those terms are defined by law
- Exercise these rights without being discriminated against
We extend the core of these rights (access, correction, deletion, and advertising opt-outs) to all of our US customers, whether or not a specific law applies to you. To make a request, email support@modemguides.com with "Privacy request" in the subject line. We will verify your identity, usually by confirming you control the email address on your order, account, or buyback submission, and respond within the time required by applicable law. We may retain information we are legally required to keep, such as tax records for completed transactions. If we decline a request, you may appeal by replying to our response.
European Economic Area and United Kingdom
If you are in the EEA or the UK, you have similar rights under the GDPR and UK GDPR: access, rectification, erasure, restriction, portability, and objection, plus the right to withdraw consent at any time and to lodge a complaint with your local supervisory authority. Our legal bases for processing are performance of a contract (fulfilling your order or buyback), legitimate interests (running and improving the store, preventing fraud), consent (marketing and non-essential cookies where required), and legal obligation (tax and accounting records). We operate from the United States, so information you provide is processed and stored in the United States.
Children's Privacy
Our store is not directed to children, and we do not knowingly collect personal information from anyone under 13. If you believe a child has provided us personal information, contact us at support@modemguides.com and we will delete it.
Changes to This Policy
We may update this policy from time to time. When we do, we will update the "Last updated" date at the top of this page, and for significant changes we will post a notice on the site.
